The ASCI approached the advertiser (yourself) for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek Informal Resolution (IR) of the complaint by modifying or withdrawing the claims objected to in the advertisement, or alternately to substantiate the claims with the required supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail nor did they submit their written response. The Consumer Complaints Council (CCC) noted that no response was received from the advertiser prior to the prescribed due date for this complaint. The CCC viewed the Facebook advertisement (https://www.facebook.com/103911884489207/posts/275525360661191/) and observed that the advertiser is in the business of real estate and is offering booking for 1and 2 Bed homes in Vikhroli. It was seen that the body copy of the advertisement says, “………. with picturesque views of Vikhroli Mangroves………” and does not say that the residential project is in the actual Mangroves. The CCC opined that even if the building is still under construction, considering the technologies available, the pictures can be clicked with the help of a drone or similar photography techniques from a height that is more real to that of the finished buildings to get the said view. Based on these observations, the CCC did not consider the Facebook advertisement to be objectionable, and hence it is not in contravention of Chapter I of the ASCI Code. This complaint was NOT UPHELD.
